Director of Proconsumidor warns that he will go after financial institutions that fail to comply with measures

The director of the National Institute for the Protection of Consumer Rights (ProConsumidor), Eddy Alcántara, announced yesterday that they will initiate operations against the entities that are dedicated to the financing of movable and immovable property that have not complied with resolution 1511-2022, which provides that these businesses must register conditional sales contracts in Pro Consumer.

He explained that this provision is contained in the General Law for the Protection of Consumer or User Rights number 358-05, while He warned that as soon as these operations begin, “financial entities that did not comply with said resolution will be banned.”

He pointed out that these entities that are dedicated to the financing of movable and immovable property that violate the aforementioned resolution “Financial or commercial operations with consumers will be prohibited.”

The official stated that in the event that the transaction is closed or that it is prohibited due to non-compliance with the provision, “The precautionary measures instituted by law will be taken to prevent contracts that are not duly deposited from being used. and approved by Pro Consumer”.

Will request DGII intervention
Alcántara also said that this institution will request the intervention of the General Directorate of Internal Taxes (DGII) to carry out inspections and verification of compliance in relation to the payment of the corresponding taxes for this type of transaction.

He recalled that resolution 1511-2022 establishes that all commercial entities not belonging to the regulated financial sector deposit conditional furniture sale contracts with Pro Consumidor for analysis and registration.
