Woman sues Apple after losing her ripple (XRP) due to iPhone app

As cryptocurrencies such as bitcoin (BTC), ethereum (ETH) and ripple (XRP) become more popular, more and more criminals are targeting their extortion. They do this, among other things, through phishing scam. By tricking a victim into entering sensitive information on a website or app, they gain access to the victim’s crypto and make off with it. Tech giant Apple is now sued because it offered such an application of criminals in its App Store.

Hadona Diep is said to have lost her crypto after she installed the app “Toast Plus”. The app seemed to be connected to the popular Toast Wallet, but that turned out not to be the case. Deep fed her XRP private key and then lost her XRP. Attorney Joshua Whitaker represents Diep in the case and argues that the App Store’s terms and conditions do not apply in this case:

“While the App Store has terms and conditions, including limitations of liability, these terms are the product of adhesion in that consumers have no other practical means of accessing applications for the iPhones and iPads if they are not using the App Store. ; those conditions therefore do not apply to this case.”

Deep, who by the way is strikingly enough “cyber-security IT professional” was convinced that Apple thoroughly examines and reviews all applications and therefore assumed that the app was safe. She ended up losing 474 XRP worth about $400.

Apple will likely lead an army of lawyers. Nevertheless, it is an interesting case in light of the looming crypto sector where things like this will happen more often.
