Lawyers for former US President Donald Trump on Tuesday asked the Supreme Court to intervene in the legal battle over classified documents that were seized during an FBI raid on his Florida estate, escalating a dispute over the extent of an arbitrator’s powers. appointed independent reviewer of the material.
Trump’s legal team has asked the highest court to overturn a lower court ruling and allow an independent arbitrator to review the roughly 100 confidentially-labeled documents that were seized during the Aug. 8 raid on Mar-a’s estate. -Lake.
A three-judge panel of the 11th Circuit Federal Court of Appeals in Atlanta last month limited the arbitrator’s review to a larger portion of unclassified documents.
The judges, including two appointed by Trump, voted in favor of the Justice Department, which had argued there was no legal basis for the arbitrator to conduct his own review of the classified documents.
Access to records
But Trump’s lawyers pointed out in their request to the Supreme Court that it was essential that the special arbitrator have access to the classified records to “determine whether the secrecy-labeled documents were indeed classified and, regardless of their classification, whether those records are personal or presidential documents.
“Because President Trump had absolute authority over confidentiality decisions during his presidency, the current status of any disputed document cannot be determined solely from the indications in said document,” the request says.
