Public Procurement explains exception processes; 56.4% of them refer to advertising

The General Directorate of Public Procurement (DGCP) clarified that according to the state of national emergency, in this government management only one “single” decree has been issued that declared state purchases and contracting to be emergency.

Decree number 401-20 is discussed, which lasted 45 days, by which the acquisition of supplies, medicines and other essential goods and services for the mitigation and prevention of Covid-19 was authorized, explains the General Director of Procurement Public, Carlos Pimentel Florenzán, by means of a letter sent to this medium regarding the article “End of the emergency limits public procurement facilities”, published last Wednesday under the signature of the writer.

“Under this declaration, it only authorized the Ministry of Public Health, the National Health Service (SNS), the Essential Medicines Program and the Central Logistics Support Program (Promese / CAL), and the Autonomous University of Santo Domingo to make purchases and emergency contracts. Once the aforementioned decree came into force, said institutions were not empowered to carry out exception processes under the national emergency modality, so they had to undergo the ordinary selection procedures “or other exception processes that best fit the need of the institution ”, adds the letter.

Pimentel explains that although it is true that during this management period contracts have been signed under the modality of exception, this includes the contracting of advertising, exclusivity, sole supplier, emergencies, scientific, technical, artistic and restoration works of monuments and of National security.

“When exception processes are analyzed under these disaggregations, it is obtained that, Since the beginning of the current management, 56.4% of the exception processes refer to advertising processes, 16.8% to exclusive processes, 14.9% to single supplier processes, 8.5% to emergency processes, 2.4% to processes related to scientific, technical, artistic and monument restoration works and only 1.02% to emergency processes ”, Details the official.

Add that Since the beginning of the current management, the institutions that trade through the Transactional Portal have awarded 72,180 contracts, of which 39.7% of the amount awarded has been through public bidding processes, 38% through exception processes, 7.8% by restricted bidding modality and 14.4% in the rest of modalities (price comparison, minor purchases, purchases below the threshold, lottery of works and reverse auctions.

“The contracts also take into account the exception modalities, and this is how it is established that 52.2% of the amounts contracted by exception refer to urgent matters, 15.9% to exceptions due to exclusivity, 12% to exceptions for advertising contracting, 11.7% for exception for sole provider exception, 2% referring to national security exceptions, 0.6% in exceptions to scientific, technical, artistic and monument restoration works and only 5.6% of the amounts awarded by the institutions that trade through the Transactional Portal they are referred to emergency processes “, details the letter signed by the director of Public Procurement.

Finally, Pimentel explains that during this period no provider has signed up in a 24 hour period. It indicates that the times currently established by the institution are two days if the request is made online and four days if it is in person, clarifying that this has nothing to do with any exception process.

A guideline prepared by DGCP in the past management for emergency purchases and contracting indicates that the institution had implemented a simplified process to register as a State supplier, so that the registration could take a maximum of 24 hours.

A bulletin published during the current administration establishes that in the first year the registration of new suppliers of the State increased 163.74% in relation to the same period (August 2020-July 2021) of the previous year.

Regarding the times for the evaluation of the technical and economic offers to carry out the awards in exceptional cases, the DGCP explains that by the criteria of decentralization and reasonableness, it is the entities that establish the times they deem appropriate.
