Nintendo has taken legal action against Human Things, the parent company of Genki, a maker of gaming accessories, in a California court. The lawsuit, filed on May 3, claims Genki violated Nintendo’s trademarks, made false advertising claims, and engaged in unfair competition.
At the heart of the issue is a prototype of the Switch 2 that Genki showcased at CES 2025. The company used 3D printing to create the mockup, which closely resembled the actual device. Edward Tsai, Genki’s CEO, claimed to have accessed the real Switch 2 before its official announcement, raising eyebrows about the company’s connections to Nintendo.
Tsai also posted on social media, suggesting Genki had “infiltrated” Nintendo’s headquarters in Kyoto. Nintendo sees this as an attempt to confuse the public about Genki’s relationship with the company.
The lawsuit demands that Genki stop producing products related to the Switch and Switch 2, destroy existing stock, and pay triple damages for trademark infringement, false advertising, and unfair competition.
Genki has since released a statement, acknowledging the lawsuit and vowing to work with its lawyers. Despite the legal challenges, the company says it will continue operating as usual.
