NFT collector is taking OpenSea to court over phishing scam – Newsbit

An NFT collector has announced that he will take legal action against the NFT marketplace OpenSea. Reportedly, the collector would not be able to enter his account for 3 months after it was locked. This lock came after the collector fell victim to a phishing scam.

Money lost for several months

It is about the OpenSea user named ‘Robbie Acres’ that after his NFTs were stolen by a phishing scam, he immediately reported it to the NFT market. However, the NFT collector claims to have done a lot of trouble. Acres said the following:

They took more than 48 hours to respond, by which time the stolen assets had been sold due to the buyer significantly undervaluing them in prioritizing pace over value.

OpenSea said in a response that they had locked the account to prevent further damage, even though it was not the solution Acres asked for. As a result, OpenSea held onto the victim’s money for 3 months, despite him stating that he wanted his assets unlocked.

Financial loss is significant

According to the victim, estimated losses amount to $500,000. Acres said, “Whether by intent or incompetence, OpenSea’s actions have caused me significant financial loss as I am an active investor in the Web3 community.”

Because he made so much loss, Acres enlisted the help of lawyers. He will therefore take legal action against the NFT marketplace. For this reason, Enrico Schaefer has been called in. He leads the Acres legal team. The lawyer confirmed that several people are dealing with the same problem. Schaefer explained the following:

I have spoken and represent several people who have had their NFTs stolen or accounts compromised on the OpenSea marketplace. In some cases, OpenSea acknowledges its mistakes and makes the account owner whole. In others, OpenSea simply ignores the problem.

According to OpenSea itself, the theft took place outside of OpenSea and the objects were already sold before the problem was apparent. Shortly after the platform became aware, the items were disabled and the user’s account was immediately locked. It is not yet known what the outcome of the legal action will be.
