The court expressed its displeasure after Malaika Arora failed to appear on April 29 despite a bailable warrant being issued against her. Chief Judicial Magistrate K.S. Jhaver noted that Malaika was deliberately avoiding court proceedings despite being aware of the summons.

The incident took place on February 22, 2012, at a five-star hotel in Mumbai. Saif Ali Khan was dining with his wife Kareena Kapoor, sister Karisma Kapoor, Malaika Arora, Amrita Arora, and some friends. NRI businessman Iqbal Mir Sharma objected to their loud behavior, leading to an altercation. Iqbal alleged that Saif threatened him and punched him in the nose, breaking it. He also claimed that Saif and his friends assaulted his father-in-law, Raman Patel.
