Yesterday, Thursday October 7, the French government published decree n ° 2021-1306 ” on the modalities for implementing measures to protect minors against access to sites disseminating pornographic content “. This decree authorizes the CSA (Superior council of audio-visual) to take measures against porn sites that do not properly verify the age of users.

Since April 23, article 227-24 of the Penal Code specifies that the simple fact of displaying a message which asks the Internet user to confirm his majority with a simple click is no longer sufficient. From now on it will be possible for the CSA to order the blocking of sites who will not take new effective measures to prevent minors from accessing their content.

The CSA will be able to block pornographic sites

Thanks to the new government decree, the CSA can now send a formal notice to the sites so that they comply with French law, that is to say that they deploy new verification tools. age.

In total, eight sites that have already received a formal notice from the CSA, including Pornhub, Xvideos, Xnxx, Xhamster, Tukif or Jacquie and Michel. If they do not quickly present new age control measures, they run the risk of a sanction ordered by the Paris judicial court, namely the end of their referencing on search engines as well as the blocking of their content by Internet service providers.

It will therefore be impossible for Internet users to access a website that has been sanctioned, since the decree will force ISPs to redirect users to an information web page belonging to the CSA. In addition, site managers also risk 75,000 euros fine or 3 years in prison.

However, since it is likely to be a blocking “by domain name (DNS)”, it is expected that tutorials will flourish on the web so that Internet users can easily bypass the court ruling.
