Court orders the release of ex-president Fujimori

Tribunal ordena excarcelar a expresidente Fujimori

The Peruvian Constitutional Court approved on Thursday a legal remedy that allows the release of former President Alberto Fujimori, sentenced to 25 years in prison for murder and corruption.

The vote in favor of a habeas corpus restores a humanitarian pardon granted at Christmas 2017 granted by then President Pedro Pablo Kuczynski, a court official told The Associated Press who requested anonymity because he was not authorized to speak.

Habeas corpus, which protects against violations of constitutional rights, including freedom, annulled a 2018 Supreme Court resolution that had nullified the pardon granted by Kuczynski. After obtaining the 2017 pardon, Fujimori lived for almost a year in a house located in a residential neighborhood in Lima. He returned to prison in October 2018.

The decision will allow the release of Fujimori – 83 years old and who governed between 1990 and 2000 – and shorten a sentence that was to end on February 10, 2032.
