California Denies Menendez Brothers Parole Over Prison Misconduct

The Menendez brothers, Erik and Lyle, will stay in prison. A California parole board recently turned down their request for early release. This decision came after a two-day hearing, despite a new sentence in May that made them eligible for parole. The brothers were convicted of killing their parents 36 years ago.

For decades, Erik and Lyle Menendez have been behind bars. They shot their parents, Jose and Kitty Menendez, at their Beverly Hills home in 1989. In 1996, they received life sentences. But public interest grew again recently, especially after a documentary. This led to a new sentencing in May, reducing their time to 50 years. This change offered them a chance to ask for parole. Many people thought this was their best shot at freedom.

The parole board questioned both brothers for two days. They asked about the abuse they suffered as children. They also wanted to know their thoughts leading up to the murders. Finally, they grilled them on their actions while in prison. The reasons for the denial became clear during these discussions.

Secret Cell Phones

One big problem was their illegal cell phone use. Commissioner Robert Barton told the brothers that these actions hurt their image as good prisoners. Cell phones in prison can be used for bad things. They might help plan attacks, move drugs, or set up assaults on staff. Having phones inside means someone brought them in illegally. Prison gangs can even charge fees for phone use.

Erik Menendez admitted he used a cell phone. He said it helped him connect with his wife. He also watched YouTube, listened to music, and viewed adult content. He told the board that the phone’s value outweighed getting caught. Commissioner Barton called Erik’s behavior “selfish.” He said it showed Erik felt rules did not apply to him.

Lyle Menendez also got caught with a cell phone twice recently. The last time was in March. Lyle claimed he let guards see him talk to his wife and family. He also said he sold their story to tabloids. Lyle saw the phone as his own private tool. He argued his marriage was strained when he moved prisons. He did not want to lose touch with his wife. “I convinced myself this wasn’t hurting anyone,” Lyle said. “Only I was breaking the rules. I didn’t think it affected prison management much.”

Not So Model Prisoners

Erik Menendez had more serious rule violations than his brother. Commissioners asked Erik about his links to a prison gang called “Two Fivers.” He helped them with a tax fraud scheme around 2013. Erik claimed he just tried to survive the prison’s extreme violence. He said friends could be stabbed or assaulted. “I was in great fear,” he explained. “When the Two Fivers asked for my help, I thought it was a good way to fit in and survive.”

Erik felt protecting himself was more important than following rules. At the time, he saw no hope of release. He also admitted to using drugs and alcohol early in his sentence. He said he stopped in 2013, on his mother’s birthday.

Lyle broke fewer rules. However, Commissioner Julia Marland noted his “antisocial personality.” She pointed to deceit, downplaying his wrongdoings, and rule-breaking. She said these traits hid under his good image. Marland warned that inmates who break rules might do the same outside prison.

The Mother’s Murder Remains an Issue

Both commissioners were troubled by the murder of Kitty Menendez. Commissioner Barton said Erik showed a deep lack of human empathy back then. “I can’t put myself in your shoes,” Barton stated. “I don’t know if I’ve ever been that angry at anyone.” This was especially concerning since their mother was also a victim of domestic violence.

Barton noted that the brothers were not in immediate danger when they committed the crime. They could have asked other family members for help or gone to the police. For Lyle, Ms. Garland called his final shot at Kitty Menendez “exceptionally heartless.” She also worried about his attempts to hide his actions. This included lying to the police and trying to avoid prosecution.

Tougher Parole in California

California is known for its strict parole process. Governor Gavin Newsom had previously ordered a risk assessment for the Menendez brothers. This was to help the parole board make its decision. The public did not see the full results. However, Los Angeles County District Attorney Nathan Hochman said in May that they were “medium risk” inmates.

The Prison Policy Initiative released a study in 2022. It found that medium-risk inmates in California only have a 22% chance of getting parole. This makes California one of the hardest states for inmates to gain release.

Family Support Remains Strong

More than ten Menendez relatives spoke at the August 21-22 parole hearing. They all supported Erik and Lyle’s release. Teresita Barault, Jose Menendez’s sister, said she had stage 4 cancer. She wanted to welcome her nephews home. “I want to be clear that even though I loved my brother, I forgive Erik,” Ms. Barault stated. “Erik has shown kindness, honesty, and strength from his patience and politeness.”

Natasha Leonardo, Kitty Menendez’s niece, promised the parole board a loving home. She offered Erik a stable place in Colorado. There he could spend time with family and nature.

After the parole board’s decision, Menendez family members released a statement. They expressed disappointment but kept their spirits up. “We know they are good people who have tried to reform themselves and show remorse,” they said. “We love them unconditionally and will stand by them on this journey ahead.”
