The Counterfeit Crime Unit (CCU) from Amazon and the BMW Group have won a joint civil lawsuit the first of its kind in Spainwhich they filed against four local counterfeiters who were trying to sell counterfeit parts and accessories from German car manufacturers across Europe.
The sentence of Trademark Court of the European Union (EU) of Alicante has decided that “The defendants violated the law (including infringing BMW Group’s trademarks) and also Amazon’s policies by attempting to sell counterfeit products such as valve covers, badges and key chains.«.
Amazon stressed in a statement that it has “proactive” measures in place to detect and prevent the offering of counterfeit products in its stores and that it “continuously monitors its website to prevent these crimes.” In this case, Amazon has detected suspicious activity advanced machine learning tools and worked closely with the BMW Group to confirm that the products in question were counterfeits.
Amazon then took action against the defendants’ seller accounts, removing products related to the case and issuing refunds to affected customers.
