A woman has been given permission to collect her late husband's sperm

A court in Australia has allowed a woman to collect and store her late husband's sperm.

The 61-year-old man died in a Perth city hospital in mid-December. Apparently he planned to have a child with his wife.

So the woman decided to sue the hospital in the Supreme Court of the state of Western Australia because the doctors refused to carry out this extraction sperm.

During a hearing, she argued that they lost their two children, ages 29 and 35, in accidents; That's why they wanted to have another baby after 40 years of marriage.

And they had agreed to the suggestion of a cousin living in the Philippines to have the child through surrogacy.

However, the laws forced the man to live in this Asian country for a while, and the outbreak of the pandemic delayed his plans.

The woman must obtain further approval

Judge Fiona Seaward heard her arguments and ordered the hospital to grant the 62-year-old woman's application due to the “traumatic” moment she experienced.

But the ruling also stated that sperm may not be used without a court order.

“These orders are limited to authorizing semen collection and do not constitute authorization for its use by the applicant,” Seaward said.

The woman must now transfer the case to another court in Australia to have a child; since not all states in this country allow postmortem insemination.
