RHOA’s Kandi Burruss Divorce: Todd Tucker Demands Custody, Challenges Prenup

Todd Tucker, estranged husband of Kandi Burruss of The Real Housewives of Atlanta, is seeking primary physical custody of their two children. He is also challenging the validity of their prenuptial agreement, according to an exclusive report by Us Weekly.

Tucker filed his response to Burruss’s divorce petition on November 26. He stated that their children, Ace and Blaze, currently live with him in Georgia.

Burruss, 49, is frequently away from home due to "out-of-state work obligations." Tucker, 52, noted these commitments are expected to continue for "at least the next few months."

The former couple shares son Ace, born in 2016, and daughter Blaze, born in 2019.

In his filing, Tucker proposed that Burruss would have "sufficient time and meaningful access to the children." His attorney praised Burruss as a "loving and capable mother."

Tucker’s legal team stated he would seek primary physical custody, shared legal custody, and final decision-making authority if an agreement on custody is not reached.

A significant point of contention is the prenuptial agreement signed before their April 2014 marriage. Tucker admitted signing the document.

However, he claims he was pressured to sign it without his attorneys present. His lawyers allege the final agreement was presented to him "immediately before the wedding ceremony" by Burruss’s attorney, without prior notice to his legal team.

These circumstances "raise substantial questions about the enforceability of the document," Tucker’s filing stated. Despite this, he remains committed to an amicable resolution.

Tucker’s counter-petition also demands a "division of all marital assets." He requests alimony if the prenup is deemed unenforceable by the court.

Kandi Burruss initially filed for divorce on November 21. She cited an "irretrievably broken" marriage with "no reasonable hope of reconciliation."

Her petition indicated a separation date of July 15, 2025. This date suggests a future effective separation.

Burruss requested shared custody of the children, believing it is in their best interest.

She also asked the court to uphold the prenuptial agreement. Burruss stated that debts incurred during the marriage should be equitably divided as stipulated by the prenup.

Burruss publicly announced the separation to People on November 21. She confirmed her decision to proceed with a divorce.

She described it as "a difficult and emotional time." Her primary goal is to "protect my peace, be the best mother possible, and raise my children with love and respect."

Burruss added that she is "starting a new stage, focusing on my work, my family, and my own growth." She requested privacy and understanding during this transition.

In a separate interview, Burruss mentioned that the separation had been "brewing" for a while.
